This User Agreement ("Agreement") is between you ("Customer" or "User") and Orchestrate Mortgage and Title Solutions LLC ("the Company"), a Texas-based provider of title search services. By accessing our website or using our services, you agree to comply with the terms and conditions set forth below.
Ownership and Use
- Website Ownership: The website and all its content, including software and data, are owned by Orchestrate Mortgage and Title Solutions LLC.
- Authorized Use: You may access, copy, print, and save documents ordered through our paid services. Unauthorized use of your account is prohibited, and you must take steps to prevent it.
Services Provided
Scope of Services: We provide title searches, document searches, abstract services, document copy ordering, and billing processing. Our services are available to users in the United States and comply with federal laws.
Pricing and Payments
- Pricing: Prices and fees are subject to change. Each service is priced separately, and you are responsible for any additional taxes or shipping charges. Changes in pricing will be displayed before you complete your payment.
- Payment: Payment is required before services are delivered. Billing begins once you confirm your order. If your payment method fails, you are responsible for resolving any outstanding balances and any resulting fees.
Termination of Service
We reserve the right to terminate this Agreement if you violate its terms, provide false information, or engage in illegal activities. To restore your account, submit a written request with a signed copy of this Agreement via email or fax.
Warranty and Disclaimer
Our Warranty
We warrant that data provided is legally obtained from public records. However, we do not guarantee the accuracy of data entered by third-party recorders or clerks.
General Disclaimer
Our services are provided "as-is" without guarantees. While we strive for accuracy, we cannot promise error-free or complete documents. We are not liable for losses due to errors or omissions, whether caused by negligence, accidents, or other reasons.
Limitation of Liability
Our liability is limited to the amount you paid for our service. You have 20 days to request a refund by submitting a written request and a signed copy of this Agreement via email or fax.
Indemnification
You agree to indemnify and hold harmless Orchestrate Mortgage and Title Solutions LLC from any third-party claims arising from your use or misuse of our services.
General Terms
- Modifications: Any changes to this Agreement must be in writing and signed by both parties. We reserve the right to update the Agreement with a 30-day notice to you.
- Service Delays: We are not responsible for delays caused by emergencies, health issues, office schedules, or other unforeseen circumstances. We will inform you of any such delays.
Service Turnaround Time
- Standard Turnaround: Our typical service turnaround is 24 to 48 / 72 business hours, starting at 8:00 am CST. Orders placed after business hours will begin processing the next business day. And the TAT are subject to type of Business Segment/Product Type/Transactions type and may change accordingly.
- Potential Delays: Some orders may take longer due to common name issues, rural locations, complex title searches, commercial properties, or 30-year searches.
Customer Responsibilities
After placing an order, you will receive a confirmation email with a summary. Contact us immediately if you do not receive this email. Review the summary and notify us of any errors promptly. If you do not report errors, you may not be eligible for a refund. Non-refundable errors include, but are not limited to, incorrect/incomplete addresses, incorrect parcel numbers, incorrect names, and invalid email addresses causing undelivered reports.
